Title Protection

There is also protection for work titles

For example, if you write a work as an author, software developer, musician or filmmaker, you create intellectual property that is protected by copyright. The title of this work indicates its content and nature and distinguishes it from other work titles.

The title protection saves the title before publication

The title protection is usually created by the start of use. As soon as a book, film, sound carrier etc. is published, its title is automatically protected by copyright. However, since the production of an intellectual work can take a long time, the author, artist or software developer can protect the planned title even before the work is published. There is the possibility of submitting a title protection notice to appropriate publications. For example for book titles, this is the “Börsenblatt” of the German Publishers and Booksellers Association.

The right of the older mark also applies to title protection

Simply contact us, if you need assistance in placing a title protection notice. The same principle applies to both brand names and titles: “Whoever comes first can claim the copyright.” This means that the right always belongs to the person who either uses it first or declares it in a title protection notice prior to publication first. In order to avoid legal infringements in advance, we offer title searches to find out whether a planned title can be used or whether it is already taken.
